Legal Representation for All Immigration Issues
Dealing with any type of immigration matter can be a challenge. You must complete a considerable amount of paperwork, and everything must be done correctly. Then, you must contend with a sometimes slow and frustrating process that is tightly controlled by USCIS. Along the way, you need an advocate who can both explain the law and provide you with the legal help that you need for a successful result. At The Hayoon Kane Law Firm, PLLC, that is exactly what we do for our clients.

Here are some of the individual areas in which we can help with your visa or green card application.
Business Immigration
There is a wide range of programs that can allow you to obtain a visa or green card for business purposes. You may qualify for a visa as an investor in the United States. For example, the E-2 visa program allows people from certain treaty countries to enter the United States if they make a substantial investment in a United States business. The EB-5 visa program can provide entry to a person who invests $1.8 million for standard projects or $900,000 in projects in Targeted Employment Areas, such as high-unemployment areas.
Employee Immigration
There are several types of employment visas that allow employers to bring a worker into the United States. An H1-B visa covers workers in specialty occupations for those who have at least a bachelor’s degree. These visas are temporary in nature, but the employees are permitted to work while they are in the country. There is also a category of permanent employment visas that come with a green card, but the number of available visas in the classification is capped, meaning that there are strict limits on how many can be issued each year.
Because of these quotas and the complex eligibility requirements, it’s critical to ensure that every step of your application is handled correctly. Our firm assists both employers and employees in preparing labor certifications, filing petitions, and responding to requests for evidence to improve the likelihood of approval.
Talent Immigration
If you have a special talent, there are multiple ways that you can enter the United States. Potential visa categories include:
- O-1 visas are for those who have achieved national or international recognition in fields such as science, business, arts, education, or athletics.
- An EB1-A green card is for top professionals who can demonstrate sustained acclaim and contributions to their field.
- An EB-2 national interest waiver visa can be obtained by individuals whose work benefits the U.S. and is deemed in the national interest.
Family Immigration
United States citizens can bring over certain close family members, and there are no caps to these types of visas. Specifically, this category of immediate relative family immigration visa covers:
- Spouses (IR-1)
- Unmarried children under 21 (IR-2)
- Parents of U.S. citizens over 21 (IR-5)
Citizens and green card holders can apply for visas for more distant categories of relatives, and there are strict annual caps that apply, meaning that you could face a waiting period.
Humanitarian Visas
Immigrants who are in certain circumstances, either in their home country or here in the United States, may qualify for family preference visas. There are many circumstances that allow for a humanitarian visa, and some include:
- Victims of human trafficking
- Those who may qualify for temporary protected status
- Individuals who are seeking asylum or refugee status based on the circumstances and conditions in their home country
- Victims of certain crimes who assist law enforcement in investigations or prosecutions
For each of these categories, you must prove that you meet the requirements for the individual type of visa.
Visas for Students
Due to recent changes in the political environment, there are additional challenges in obtaining student visas. There are three types of student visas for which you can apply:
- F1 visas are for academic purposes for those attending accredited U.S. colleges, universities, high schools, or language training programs on a full-time basis.
- M1 visas are for students enrolled in vocational or technical programs, such as trade schools.
- J1 visas are for students who are participating in approved exchange programs, including high school or university study, internships, or research.
There are requirements that must be met to qualify for a student visa. The student must have financial support and intend to return to their home country at the conclusion of their studies.
Citizenship & Naturalization
As a holder of a green card, you are entitled to apply for United States citizenship when you meet the following requirements:
- You have physically lived in the U.S. for at least 30 months (half of the 5 years).
- You have resided in the same state for at least 3 months before applying.
- You are of good moral character and comply with U.S. laws.
